Introduction and Acceptance of Terms

Welcome to FIBO 2, an online AI image generator and photo editor. You can create pictures from text prompts, edit photos with instructions, and manage your work in a private gallery on our platform. By accessing or using our website and tools at fibo-2.org, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, do not use the service.

FIBO 2 is an independent service that provides an editor and gallery for the FIBO 2 model. We are not the model developer and are not affiliated with or endorsed by the model's developer.

Use of the Service

FIBO 2 provides tools for writing prompts, uploading photos for editing, choosing generation settings such as aspect ratio, processing AI image requests, and downloading generated outputs through our platform. You agree to use the service in compliance with all applicable local, national, and international laws and regulations.

User Accounts and Registration

1. Account Creation: To access certain features, generation credits, paid tiers, download history, or support options, you may need to create an account. You must provide accurate and complete registration information.

2. Account Security: You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly if you suspect unauthorised use.

3. Usage Credits/Limits: Your account may include generation limits or credits based on your plan. You are responsible for how you use them.

Content and Intellectual Property Rights

1. Your Prompts, Uploads, and Generated Images:

   • You retain ownership of prompts, photos, and other materials you lawfully submit to FIBO 2, subject to applicable law.
   • Subject to these Terms and your plan, FIBO 2 grants you a licence to use the image outputs ("Generated Content") produced from your submissions, within the scope allowed by your plan and applicable law.
   • You must have all necessary rights, consent, and permissions for every photo, likeness, trademark, text, branding, or other content you upload or describe in a prompt, and for how you use Generated Content.
   • Generated images may vary in quality, layout accuracy, text rendering, colour, resolution, style match, and edit fidelity based on your prompt, uploads, settings, model behaviour, system capacity, and technical limits.
   • FIBO 2 and its licensors retain all rights in the platform, software, interfaces, workflows, and underlying technology used to operate the service.

2. Platform Technology:

   • The FIBO 2 platform is owned by or licensed to the operator of fibo-2.org and is protected by copyright and other intellectual-property laws.
   • You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code, prompts, workflows, or underlying models from our service, except where law forbids such restrictions or we give written permission.

3. No Endorsement by Third Parties:

   • You must not state or imply that your use of the service, your Generated Content, or this website is officially endorsed by the model developer or any other person, brand, platform, trademark owner, or rights holder unless you have permission.

Prohibited Activities

You agree not to:

• Upload or generate content that infringes copyright, trademark, privacy, publicity, likeness, or other rights.
• Use photos of real people without their consent, especially where consent is required by law.
• Upload photos of minors unless you are legally authorised to do so and the use is lawful and appropriate.
• Use celebrity, public figure, copyrighted, or misleading likenesses in violation of law, platform rules, or these Terms.
• Create content intended to deceive, defraud, impersonate, harass, threaten, shame, exploit, or mislead others.
• Create unlawful, harmful, defamatory, obscene, hateful, discriminatory, or otherwise objectionable content.
• Misrepresent your affiliation with FIBO 2, the model developer, or any other person, brand, or platform.
• Bypass usage limits, billing systems, access controls, safety measures, or security systems.
• Resell or redistribute access to the service without permission.
• Interfere with or disrupt the service, servers, networks, or third-party systems we rely on.
• Attempt to extract, replicate, scrape, or reverse-engineer our systems or third-party components except as allowed by law.
• Use FIBO 2 for any illegal purpose.

Content Generation Guidelines

1. Prompts and Uploads:

   • Submit only content you have the right to use, including photos you own or have permission to edit.
   • Do not upload illegal, hateful, abusive, explicit, exploitative, or non-consensual material.
   • When editing photos, clearly describe what should stay the same and what should change.

2. Generated Content Use:

   • You are responsible for reviewing Generated Content before downloading, sharing, publishing, or using it commercially.
   • If you publish Generated Content on social platforms, websites, or ads, you are responsible for following those channels' rules and any third-party rights that apply.

3. Usage Limits and Quality:

   • Generation is subject to plan limits, credits, fair use, queue capacity, and system availability.
   • Output resolution, processing time, text in images, layout, and edit accuracy may vary based on your inputs, settings, plan, and technical conditions.

Privacy and Data Collection

FIBO 2 collects and processes data needed to run and improve the service, including account information, prompts, uploaded photos, generated images, usage metrics, technical data, and payment details where applicable. See our Privacy Policy for full details.

Pricing and Subscriptions

• Plans, credits, and pricing are shown on fibo-2.org or in the product.
• Payments are handled by third-party payment processors.
• Purchases are generally final and non-refundable unless required by law or stated otherwise in plan terms.

Service Level and Support

FIBO 2 is provided "as is" and "as available." Availability, processing speed, queue time, image quality, model behaviour, and output may vary. Support options may depend on your plan. Maintenance, third-party infrastructure, or AI processing providers may cause temporary interruptions.

Termination

We may suspend or terminate your access if we believe you violated these Terms, harmed other users or the service, created legal or safety risk, bypassed limits, misused uploaded content or likenesses, or for other legitimate reasons, with or without prior notice where permitted by law.

Disclaimer of Warranties

The service is provided without warranties of any kind, whether express or implied. AI-generated image results can vary based on inputs, settings, model behaviour, and technology limits. We do not warrant uninterrupted, error-free, fully secure, or perfectly accurate operation, and we do not guarantee that any generated image will meet your expectations or third-party requirements.

Limitation of Liability

To the fullest extent permitted by law, FIBO 2 and its affiliates, officers, employees, agents, suppliers, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, use, goodwill, reputation, platform accounts, or other intangible losses arising from your use of or inability to use the service, third-party conduct, Generated Content, uploads, publication of outputs, or unauthorised access to your data—whether based on warranty, contract, tort, or other theory, even if we were advised of the possibility.

Changes to These Terms

We may update these Terms from time to time. The current version will be posted on fibo-2.org. If changes are material, we may notify you by email or in the product. Continued use after changes take effect means you accept the revised Terms.
